  1.                  DECISION ON CERTAIN DISPUTE SETTLEMENT
  2.         PROCEDURES FOR THE GENERAL AGREEMENT ON TRADE IN SERVICES

  5.       Ministers recommend that the Council for Trade in Services at its 
  6. first meeting shall adopt the decision set out below.

  9.                         DISPUTE SETTLEMENT PANELS
  10.  
  11. The Council for Trade in Services,
  12.  
  13.       Taking into account the specific nature of the obligations and 
  14. specific commitments of the Agreement and of trade in services with respect 
  15. to dispute settlement under Articles XXII and XXIII,
  16.  
  17.       Decides as follows:
  18.                            
  19. 1.    A roster of panelists shall be established to assist in the selection 
  20. of panelists.    
  21.  
  22. 2.    To this end, Members may suggest names of individuals possessing the 
  23. qualifications referred to in paragraph 3 below for inclusion on the roster, 
  24. and shall provide a curriculum vitae of their qualifications including, if 
  25. applicable, indication of sector-specific expertise.  
  26.  
  27. 3.    Panels shall be composed of well-qualified governmental and/or 
  28. non-governmental individuals who have experience in issues related to the 
  29. General Agreement on Trade in Services and/or trade in services, including 
  30. associated regulatory matters.  Panelists shall serve in their individual 
  31. capacities and not as representatives of any government or organisation.  
  32.  
  33. 4.    Panels for disputes regarding sectoral matters shall have the 
  34. necessary expertise relevant to the specific services sectors which the 
  35. dispute concerns.

  37. 5.    The MTO Secretariat shall maintain the roster and shall develop 
  38. procedures for its administration in consultation with the Chairman of the 
  39. Council.
